Sigh, I really was trying to stay out of this one. It seems like derivative use of the Genesis 2 rig, the open source reference could be an issue for one thing as Wolf is free to decide the license for his self created content, but placing content that you don't actually own or derivative content under an Open Source license could be an issue. Auto fitted Clothing, hair and such is generally regarded as okay, at the licence holders discretion of course. But figures tend to be a sticking point whether proxy or not and may run into issues at the copyright holders discretion. It may come as a surprise but there are quite a number of commercial products in 3rd party stores that could easily be seen to breach of each others terms of use. But rights holders may choose to allow the sale of these products for their own reasons. Both Renderosity and Hivewire3D's terms could be defined as being even tighter than Daz 3D's, with no clauses to permit the creation and distribution of derivative content at all, but clear terms stating it is breaking the rules. Under Hivewire3D's terms Dawn figure derivatives are not allowed for resale under their licence terms 4C. The licence for the content distributed with Poser is also similarly protected if not more murkily written into the terms of their EULA.

Does this freebie breach the Daz 3D Eula? Honestly only Daz 3D could say.

I downloaded the file to have a look at the package, it doesn't actually contain the data files which hold the required geometry, so is basically just the raw Genesis 2 rig renamed and zipped up.

The relevant statements in this case are:

"Content License. Daz grants to User and User hereby accepts, subject to the limitations and obligations of this Agreement, a personal, non-exclusive, non-transferable license to use the Content, duly obtained by payment of all applicable license fees, as provided in this Agreement."

"The Content is for User’s exclusive use and no other individual or entity. Each individual must obtain his or her own license to use the Content."

"Three Dimensional Works. Daz wishes to encourage the expansion of the catalog of Content available to its users. Accordingly, User may access, use, copy, and modify the Content to create one or more derived or additional three-dimensional works provided that:"

"any such derived or additional three-dimensional works are designed to require or encourage the use of Content available through the online Daz store either by (i) requiring the use of such Content to function, or (ii) allowing only limited function when not used in conjunction with Content from the online Daz store; and"

"upon receipt of a written request from Daz, User will immediately cease any and all distribution of the derived or additional three-dimensional works User has created from the Content, if Daz has determined, in its sole discretion, that (i) such additional or derived work is substantially similar to or is a clone of existing Content; or (ii) such additional or derived work fails to require or encourage the use of Content available through the online Daz store as described above."

Solutions: Distribute the low res meshs on their own with instructions provided on how to auto fit the new mesh to Genesis 2 Rig or B ask Daz 3D what they think of the idea. Or option C risk it and wait for a possible cease and desist letter.
